1. Acceptance of These Terms
These Terms of Service are a binding agreement between you and Veralore, a Colorado-based business operated by Russ Gallivan, governing your access to and use of the Veralore website, family memory tools, digital guides, subscriptions, gift purchases, SMS features, and related services.
By creating an account, purchasing a digital guide, subscription, or gift, uploading content, inviting family members, turning on text message nudges, or otherwise using Veralore, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into this agreement to create or administer a Veralore family space.
You are responsible for the accuracy of information you provide, for maintaining access to your sign-in email, and for all activity under your account or family space.
Veralore may suspend or terminate access if we believe an account is being misused, is insecure, violates these Terms, or creates legal, security, operational, or reputational risk.
3. Family Content
Family Content means photos, questions, voice recordings, transcripts, story drafts, names, dates, places, memoir material, comments, and other content submitted to or generated through Veralore.
As between you and Veralore, you retain ownership of Family Content you submit. You grant Veralore a limited license to host, store, copy, process, transmit, display, transcribe, analyze, transform, and otherwise use Family Content solely to provide, maintain, secure, support, and improve the service.
You represent and warrant that you have all rights and permissions necessary to upload, record, share, process, and preserve Family Content, including permission from living people whose voice, image, phone number, likeness, or personal information you provide.
You are solely responsible for Family Content and for family permissions, disputes, and decisions about who may access or share a family space.
4. Acceptable Use
You may not use Veralore for unlawful, harmful, abusive, harassing, deceptive, infringing, exploitative, obscene, or invasive purposes.
You may not upload content that you do not have the right to use, attempt to access another family's data, interfere with the service, reverse engineer the service, bypass security controls, or use Veralore to send spam, unsolicited messages, or unlawful communications.
Veralore may remove content, limit access, or disable features when we reasonably believe these Terms have been violated or action is needed to protect users, families, service providers, carriers, payment processors, or Veralore.
5. Digital Products, Subscriptions, Gifts, Billing, and Taxes
Digital products, paid subscriptions, trials, renewals, gift access, prices, features, and plan limits are presented at checkout or in the app and may change prospectively.
Digital guide purchases include a personal and household-use license. You may not resell, publish, upload, or redistribute the files except where applicable law gives you that right.
Unless a checkout page or written offer says otherwise, subscriptions renew automatically until canceled, and you authorize recurring charges using the payment method you provide.
You are responsible for all applicable taxes, fees, and charges associated with your purchase. Payment processing is handled by third-party payment providers.
Failure to pay may result in suspension, loss of access to paid features, or termination of the account, subject to any export or deletion rights described in our policies.
6. Cancellation and Refunds
Cancellation and refund terms are described in the Refund and Cancellation Policy, which is incorporated into these Terms.
Canceling stops future renewal charges but does not automatically delete Family Content. You may request export or deletion as described in the Data Deletion Policy.
7. SMS and Email Communications
Veralore may send transactional, account, security, billing, family invite, story prompt, and service-related emails.
If SMS text message nudges are enabled for a loved one, Veralore may send text messages as described in the SMS Terms. SMS consent is optional and may be revoked.
You represent that any phone number you provide belongs to a person who has authorized Veralore text messages for the stated family memory purpose.
8. Third-Party Services
Veralore depends on third-party providers for hosting, database, authentication, storage, email, SMS, payment, transcription, AI, and related services.
Veralore is not responsible for third-party outages, delays, errors, carrier filtering, payment processor decisions, network issues, or service provider acts or omissions outside Veralore's reasonable control.
9. AI, Transcripts, and Generated Materials
Veralore may use automated tools, speech recognition, transcription, and AI-assisted features to create transcripts, summaries, prompts, story drafts, memoir previews, and related outputs.
Generated materials may be incomplete, inaccurate, or imperfect. You are responsible for reviewing, editing, and deciding whether to use or share generated materials.
Veralore does not guarantee that transcripts, suggestions, or story drafts will be accurate, complete, historically correct, or appropriate for every family circumstance.
10. No Professional Advice
Veralore is a family memory and educational publishing service. It does not provide legal, medical, financial, mental health, estate planning, archival, genealogical, or tax advice.
You should consult qualified professionals before relying on any content or output for professional, legal, medical, or financial decisions.
11. Disclaimers
Veralore is provided on an as-is and as-available basis. To the fullest extent permitted by law, Veralore disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.
Veralore does not guarantee that the service will be error-free, secure, uninterrupted, loss-free, or that Family Content will never be corrupted, delayed, deleted, or unavailable.
12. Limitation of Liability
To the fullest extent permitted by law, Veralore and its owners, officers, employees, contractors, affiliates, vendors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, use, or business.
To the fullest extent permitted by law, Veralore's total liability for any claim arising out of or relating to the service or these Terms will not exceed the amount you paid to Veralore for the service during the three months before the event giving rise to the claim, or one hundred dollars, whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless Veralore and its owners, officers, employees, contractors, affiliates, vendors, and service providers from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the service, Family Content, violation of these Terms, violation of law, or violation of another person's rights.
14. Changes to the Service or Terms
Veralore may modify, suspend, or discontinue any feature or plan at any time. We may update these Terms by posting a revised version with a new effective date.
Continued use of Veralore after updated Terms are posted means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules, unless applicable consumer law requires otherwise.
Any dispute not resolved informally will be brought in the state or federal courts located in Colorado, unless applicable law requires a different forum.
